In a significant development, the Central Administrative Tribunal (CAT), Jammu Bench, while hearing the case C.P./249/2021 in O.A./269/2021 titled Kamal Singh Vs Shri Sailendra Kumar, Commissioner Secretary to PWD (R&B) and Others, has strongly questioned the denial of pensionary benefits to the petitioner, Kamal Singh, a retired employee of the Public Works Department.
During the proceedings, the respondents submitted a compliance report, which upon examination by the Tribunal revealed that the petitioner was denied his pensionary benefits based solely on an FIR registered by the Crime Branch in the year 2023—nearly four years after his retirement. The Tribunal remarked that the legal position on such matters is well settled: no departmental action or penalty can be taken against a government employee after retirement.
Taking serious note of the issue, the Tribunal directed the Learned Deputy Advocate General (DAG) to file a fresh status report explaining the circumstances under which the pensionary benefits were withheld. It warned that in case of non-compliance, Respondent No. 3 shall appear before the Tribunal through virtual mode on the next date of hearing to offer an explanation. The matter has now been listed for further hearing on July 14, 2025.
In the meantime, the Tribunal allowed the learned counsel for the petitioner to file a Miscellaneous Application for substitution of new incumbents if necessary. It was also directed that the name of Mr. Nitin Verma, counsel for the petitioner, be reflected in future cause lists.
This order has highlighted potential procedural violations and has raised serious questions regarding the denial of rightful post-retirement benefits to a government employee. The Tribunal’s directions are expected to ensure greater accountability in handling pension-related matters.
