Jammu, May 24: In WP(C) No. 1321/2023 CM No. 3183/2023 titled Faizan Mustafa V/s Union Territory of J&K and ors.after hearing HON’BLE MRS. JUSTICE SINDHU SHARMA, JUDGE ORDERED as:-
The petitioner was engaged on 06.06.2016 as Gram Rozgar Sevak on compassionate grounds in place of his brother, who died in harness.
The respondent No. 1 issued a Government Order No. 203- RD&PR of 2018 dated 09.08.2018, vide which it was order that all the contractual engagements made under the MGNREGA scheme in contravention to rules/norms/guidelines in vogue and without following due procedure shall be discontinued with immediate effect.
The petitioner along with seven other persons assailed this order dated 09.08.2018, by way of writ petition i.e., SWP No. 1731/2018 in which, this Court vide order dated 30.08.2018 was pleased to direct that the status of the petitioners be maintained.
The petitioner thereafter approached the respondents for release of arrears of wages in lieu of the services rendered by him.
The respondents instead of releasing the arrears of salary, have issued the order impugned dated 05.04.2023 vide 2 which District Programme Coordinator, Rajouri has directed to discontinue the services of the petitioner in terms of the same Government Order No. 203-RD&PR of 2018 dated 09.08.2018 which is already sub-judice in SWP No. 1731/2018 and in which the interim orders has already been issued.
